What is VillaXL?
VillaXL is a modern rental organisation offering stunning holiday homes and villa's in Belgium (the Ardennes), France, Austria, Spain, Italy, Ireland and elsewhere. Our website makes booking a cabin in the Alps or a luxury villa in the south of France very easy. And because our rentals are only offered online, you are guaranteed the most up-to-date offerings and competitive prices.

General booking conditions
I General Terms in this Contract
1.1. Villa XL, the name of the organisation acting as intermediary letting holiday homes on the instructions of the owners and/or their representatives.
1.2. The principle tenant: the person who rents a holiday home from the selection available at Villa XL.
1.3 Joint tenants: one or more people who stay at the holiday home at the same time as the principle tenant.
1.4. The owner: the owner of the holiday home (or his/her representative).
1.5. The agreement: the rental agreement between the owner and the principle tenant
1.6. The general booking conditions: The current general booking conditions used by Villa XL.
1.7. The website: Villa XLs own website with the internet address: www.villaxl.com.
II Application of the General Booking Conditions
The general conditions applies to all offers, quotes, agreements, contracts and services provided by Villa XL, including agreements where Villa XL acts on behalf of both parties, unless both parties choose a different agreement.
The tenant accepts these general booking conditions, which form part of the rental agreement, on confirming his/her reservation and no further written agreement is necessary from Villa XL or the tenant.
III Offers and Quotes
3.1. All offers and quotes from Villa XL, in whichever form, are without obligation.
3.2. All the details and prices regarding holiday homes on the Villa XL website are as accurate as possible. These details are only binding after written confirmation from Villa XL. Villa XL is not responsible for mistakes and omissions on its website. The tenant confirms he/she has understood the description of the holiday home in question and does not need any further details.
3.3 The description of the holiday homes on the website serves as an indication and general description of the properties. Some parts may not be completely accurate. If the property is unique or of historical value it may not conform to modern building standards such as height, width and light requirements.
IV Agreement
4.1. The agreement is between the owner and the tenant. Villa XL is not a partner in any agreement.
4.2 The agreement is binding when the confirmation has been sent by Villa XL and received by the tenant. The confirmation contains content and details of the agreement in a complete and accurate way.
4.3. The contents of the agreement will be deemed correct by this confirmation. The tenant should check the agreement carefully and report any inaccuracies to Villa XL within two working days of receipt of the agreement.
4.4. Any further additions or changes to this agreement (verbal or written) by or on behalf of Villa XL or any of its employees, are only legally binding if confirmed, as in 4.2, in writing. Any additions or changes made by the tenant will incur extra administration charges, and the tenant will be billed by Villa XL for these charges.
4.5 The duration of the agreement is stated in the written confirmation and ends on the last date.
V Cancellation
5.1. The tenant may cancel a booking in writing without incurring extra costs if this is done within two working days after the confirmation has been sent, unless the rental period starts less than one month after the cancellation.
5.2. If a booking is cancelled after the two days notice as in 5.1. the tenant is required to give written notice of the cancellation and pay cancellation costs as below:
a. in the case of cancellation up to 42 days before the day of arrival: 30% of the total rental costs.
b. in the case of cancellation from the 42nd day to the 28th day before the day of arrival: 60% of the total rental costs.
c. in the case of cancellation from the 28th day till the day of arrival: 90% of the total rental costs
d. in the case of cancellation on the day of arrival or later: the total amount of the rental costs are due.
5.3. A cancellation made by the principle tenant will also be valid for any other tenants staying at the property at the same time as the principle tenant.
5.4. A cancellation made on a Saturday or a Sunday or a bank holiday in the Netherlands, will be valid as from the first following Dutch working day.
VI Rental and payment
6.1. Unless otherwise agreed in the rental agreement, the rentals costs:
- are based on the rental amount agreed in the agreement:
- include sales taxes;
- include any explicit costs mentioned in the description of the holiday home on the Villa XL website;
- exclude reservation costs;
- exclude tourist tax and any cleaning costs and such like;
- are in euros.
6.2. The principle tenant must pay 50% of the rental costs within ten calendar days after signing the agreement as in article 4.2 above. The money should be paid to the account number shown on the Villa XL agreement. The date the money is received by Villa XL is date the costs are shown to have been paid on the Villa XL bank statement.
6.3. The rest of the rental costs must be paid at least six weeks before the start of the rental period. For payment details see article 6.2 above.
6.4. For bookings made within six weeks of the start of the rental period, the total rental costs must be paid within 5 days of signing the agreement. For payment details see 6.2 above.
6.5. For bookings made within 10 days of the rental period, the total rental costs must be paid by the fastest means possible. For payment details see 6.2 above. The rental costs must have been received by Villa XL within 3 days of the start of the rental period..
6.6. The rental costs must be paid in full and final settlement by the (principle) tenant.
6.7. The rental costs must be paid by the (principle) tenant without any deductions or debits.
6.8. If the rental costs are not paid on time according to this agreement the (principle) tenant will owe interest on the rental amount from the date the rental costs are due and without any further notice being served on the (principle) tenant necessary. The tenant will owe Villa XL the rental costs and statutory interest thereof, and this amount will be increased by 1% every day until the outstanding amount has been paid in full.
6.9. If the rental costs are not paid when due, Villa XL reserves the right to cancel the booking in writing, on behalf of the owner of the property. In that case the tenant will have to pay cancellation costs as in 5.2 above.
6.10 All legal costs incurred by Villa XL for collecting any payments due will be passed on to the (principle) tenant. The legal costs will be any costs Villa XL incurs if the case has to go to court. Any other costs incurred in the recovery of payments due will be charged to the (principle) tenant in the form of a fine of 15% of the total amount due, with a minimum of €100, unless these recovery costs are higher in which case Villa XL will be obliged to charge the total amount of the true costs incurred.
VII Liability: Tenant
The (principle) tenant is responsible for any damage incurred to the property during the rental period whether caused by him/herself, the joint tenants or any third parties.
VIII Liability: Owner
8.1 Any liability of Villa XL is in all cases limited to accountable deficiencies in the operations of Villa XL as an intermediary and is in all events limited to the agreed rental amount unless it is a case of bad intent or gross negligence on the part of Villa XL.
8.2 Villa XL cannot be held liable for actions and/or negligence of the owner.
8.3 Any liability of the owner, on any legal grounds, is limited to a maximum of three times the amount of the rent, unless it is a a case of bad intent or gross negligence of the
8.4 Neither Villa XL nor the owner can be held liable for the costs, which are not covered by the usual travel and/or cancellation insurance. Any liability for damage suffered by the tenant, during the carrying out of his/her profession or company business, is excluded by Villa XL and the owner, except in cases of bad intent or gross negligence.
8.5 Total liability of Villa XL, its personnel, and any contracted third parties will be limited to the relevant rental agreement and the rent paid by the (principle) tenant to Villa XL.
IX Dissolution of the agreement
9.1 Villa XL is entitled to dissolve the agreement in writing and to demand that the tenant(s) depart the premises immediately if the tenant seriously neglects to take proper care of the premises, such as if he accommodates more or different persons and/or animals than allowed according to the agreement, or if the premises is damaged or in any other way does not fulfil the obligations of a proper tenant. In that case the tenant is not entitled to restitution of (part of) the rent and the tenant is held responsible for the damage suffered by Villa XL, and/or the owner, as a consequence of any actions or omissions by the tenant.
9.2 If the owner cannot supply the house as a result of circumstances for which he cannot be blamed, Villa XL is, on behalf of the owner, entitled to dissolve the agreement. The tenant will then have the agreed rental amount reimbursed but not be entitled to any compensation. Villa XL will offer the tenant an alternative property, if available, which is of similar quality, either during the same time period or a different period.
X Problems with the rental property
10.1 If there are any shortcomings or problems with the rented property the tenant should report these to Villa XL as soon as possible, and within the first 24 hours of the rental agreement. If these are not reported on time any rights the tenant has will be deemed nul and void.
10.2 If the shortcoming or problem is received on time as in 10.1, and the shortcoming is so serious that normal use of the house is seriously hindered, Villa XL will do its utmost to solve the problem.
XI Remaining terms
11.1 The tenant is not allowed to sublet the house.
11.2 In case the terms of these conditions or parts of them would not be (any longer) legally valid or are stated non-applicable, the rest of the terms remain in force. The agreed term(s) are then changed into comparable terms which remain legally valid.
11.3 All contracts, offers and parts thereof which these general booking conditions refer to (in whole or in part) fall under Dutch law.
11.4 Any disputes between parties regarding their agreement, including the collection of any payments due, will be made pending before the local magistrate or judge, in the place of business of Villa XL, as far as the law allows

Bed and bath linen
The descriptions of the holiday homes will tell you whether bed and bath linen are available and whether or not they are included in the rental price. If linen is supplied, then you will receive one set of bed and bath linen per week, unless stated otherwise. Extra changes of bed and bath linen can be arranged with the owner. Any charges for extra linen will have to be paid directly to the owner.
Pets
The descriptions of the holiday homes state whether pets are allowed. Unless stated otherwise, a maximum of one pet is permitted per holiday home. Your intention to bring pets must always be stated when making your booking. Rights for a pet can only be claimed if the pet is mentioned on the travel documents.
Number of persons
Our holiday homes are suitable for the maximum number of people stated in the description of each holiday home. This number always includes babies (up to 4 years) and children (5 to 14 years). It is not permitted to stay in the holiday home with more than the maximum number of people stated in the description.
Additional costs
VillaXL tries to include as many costs as possible in the rental price in order to give you an ‘all inclusive’ rental price. However, this is not possible for all costs and/or holiday homes. The descriptions of the holiday homes detail any extra charges that may apply. They also explain how these costs are calculated (e.g. per week, based on actual consumption etc.).
Booking and paying
Cancellation
If the tenant wishes to cancel the agreement, then he or she must do so in writing (by fax or e-mail). If the agreement is cancelled, each person who was going to be staying in the holiday home is obliged to pay any outstanding booking fees plus a cancellation fee.
- For cancellation up to 42 days before the arrival date: 30% of the rental fee.
- For cancellation between 42 days (inclusive) and 28 days before the arrival date: 60% of the rental fee.
- For cancellation between 28 days (inclusive) before the date of arrival and the day of arrival: 90% of the rental fee.
- For cancellation on the day of arrival or later: the full rental fee.
The cancellation fees stated here will not exceed the total rental costs. We strongly recommend that you purchase cancellation insurance.
Payment
We will e-mail you confirmation after you have booked your holiday. This confirmation will state when payments are due and how they are to be paid.

Privacy conditions
VillaXL respects your privacy and will make every effort to handle all details you provide with care and in confidence. Responsibility for processing your details lies with VillaXL - Holiday Homes, Emmalaan, Bergen (NH), The Netherlands. In order to provide our services (when you submit a request or book an accommodation or subscribe to the newsletter), VillaXL will record your details. VillaXL will use these details in order to meet any relevant agreements, in order to provide other services and in order to inform clients about (new) products and services offered by VillaXL, its group companies and/or carefully selected third parties. VillaXL will do this taking your preferences into account. If you do not wish to receive information about (new) products and services, please write to VillaXL, Emmalaan 4a, 1862 ET Bergen (NH). You can also send an e-mail to info@villaxl.com. We will then ensure that your details are not used for this purpose. You may submit a written request for access to the personal details we have processed. Any incorrectly processed details can be corrected by contacting VillaXL via info@villaxl.com.

Tips before going on holiday
Good preparation helps to ensure a trouble-free holiday.
- Do not forget to bring your voucher: it is official confirmation of your booking and should be handed to the owner or key-holder upon arrival.
- Make sure that your car is in good working order before you leave. It is also important to check the oil level and tyre pressures.
- When driving, take a fifteen-minute break every two hours.
- Decide the route you are going to take before you leave. This will help you avoid dangerous situations whilst driving.
- Take your green insurance card with you. This is your international proof of insurance.
- Check whether your passports are still valid. Check whether your children are included in your passport.
- Do not forget to take out travel and/or cancellation insurance.
- Make a note of important telephone numbers, such as your insurance company. Leave a telephone number through which you can be contacted with your family or neighbours.
Insurance
You book in time, because you want to be sure you can travel to your desired destination at your chosen time. But then it is good to have a cancellation insurance, just in case. Something may happen which causes you to cancel or postpone you travel. Your travelling agency can bill you for the costs. Some times up to 100% of your travelling costs.
An insurance will insure that you are properly covered against unexpected cancellation charges. If you require cancellation cover, VillaXL in association with Europeesche Verzekeringen will be pleased to arrange it at the time of booking, though you are free to make your own arrangements. The booking form is your proof of insurance. Keep this in a safe place.
Route planners
How will you find the way to your holiday home? We will e-mail you your travel documents after you have confirmed and paid for your holiday. These travel documents contain a detailed description of the route to your holiday home once you are near your destination (often the last couple of kilometres). You can easily find the route from your home to your approximate destination using online route planners, such as
